The legal terms governing your use of AiReachly.

These Terms and Conditions ("Terms") form a legally binding agreement between you and AiReachly Inc. ("AiReachly", "we", "us") and govern access to and use of aireachly.com and all related services ("Services"). By registering or otherwise accessing the Services you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Services.

1. Parties and Agreement

These Terms constitute an agreement between you (the "User") and AiReachly Inc. Where you access the Services on behalf of a business, you warrant you have authority to bind that entity. These Terms are governed by the laws of the Republic of Ireland.

2. Services Description

AiReachly provides AI-powered brand and product ranking analysis, aggregating outputs from third-party AI models including OpenAI, Anthropic, Google Gemini, and Perplexity. Rankings, scores, and insights are generated algorithmically and provided for informational purposes only. We do not warrant their accuracy, completeness, or suitability for any particular purpose. AI outputs are inherently dynamic and subject to change without notice.

3. Eligibility and Account Registration

  • You must be at least 16 years of age and have legal capacity to enter binding contracts under Irish law.
  • Business users must be duly incorporated or established and authorised to accept these Terms.
  • You must provide accurate, current, and complete registration information and keep it updated.
  • You are responsible for all activity under your account and must maintain credential confidentiality.
  • Notify us immediately at support@aireachly.com if you suspect unauthorised account access.
  • We reserve the right to refuse registration or suspend accounts at our discretion.

4. Acceptable Use

  • Use the Services only for lawful purposes in compliance with applicable Irish and EU law.
  • Do not scrape, crawl, index, or data-mine the platform without prior written authorisation.
  • Do not reverse-engineer, decompile, or attempt to derive source code from the Services.
  • Do not use Service outputs to train, fine-tune, or benchmark competing AI models or ranking systems.
  • Do not introduce malware, viruses, or disruptive code of any kind.
  • Do not impersonate any person or entity or misrepresent your affiliation.
  • Do not circumvent account limits, access controls, or subscription restrictions.
  • Violation of acceptable use may result in immediate suspension or termination without refund.

5. Consumer Rights (EU / Irish Law)

If you are a consumer within the meaning of the EU Consumer Rights Directive (2011/83/EU) and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484 of 2013), you have a 14-day right of withdrawal from distance contracts for digital services, except where you have expressly consented to the service commencing before the withdrawal period ends and acknowledged forfeiture of that right. Nothing in these Terms affects your non-waivable statutory rights under Irish or EU consumer law.

6. Subscriptions and Payment

  • Certain features require a paid subscription. Fees are displayed in the currency shown at checkout and are inclusive of applicable VAT where required under Irish law.
  • Subscriptions are billed in advance on the selected cycle (monthly or annual). By subscribing you authorise recurring charges.
  • Payments are processed by Stripe. Your payment details are subject to Stripe's Privacy Policy.
  • We may change subscription pricing with at least 30 days prior notice. Continued use constitutes acceptance.
  • Refund requests must be submitted within 14 days of the relevant charge to billing@aireachly.com. Refunds are assessed on a case-by-case basis and do not affect statutory rights.
  • We may suspend access for non-payment following reasonable notice.

7. Intellectual Property

All intellectual property rights in the Services — including software, algorithms, UI design, trademarks, trade names, and data compilations — are owned by or licensed to AiReachly and protected under Irish and EU law, including the Copyright and Related Rights Act 2000 and EU Directive 2001/29/EC. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for your internal purposes. No other rights are granted.

8. User Content

Where you submit content to AiReachly (including feedback, brand claims, or other material), you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display that content in connection with the Services. You warrant you have the rights to grant this licence and that your content does not infringe third-party rights or applicable law.

9. Third-Party AI Models

AiReachly aggregates outputs from third-party AI providers. We do not control those providers, are not responsible for the content of their outputs, and cannot guarantee their continued availability. Changes to third-party APIs may affect ranking results without notice. Use of AI outputs is at your own risk.

10. Limitation of Liability

To the maximum extent permitted under Irish law, AiReachly's total aggregate liability — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the greater of (a) €100 EUR or (b) the total fees paid by you in the 12 months preceding the event giving rise to the claim. AiReachly shall not be liable for indirect, consequential, incidental, or special damages, or loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such loss. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under Irish law, including under the Sale of Goods and Supply of Services Act 1980.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available". To the extent permitted by law, AiReachly disclaims all representations and warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that ranking outputs will be accurate or complete.

12. Indemnification

You agree to indemnify and hold AiReachly, its officers, employees, and affiliates harmless from any claims, liabilities, damages, and costs (including reasonable legal fees) arising from your use of the Services, your breach of these Terms, or your infringement of any third-party rights.

13. Termination

Either party may terminate this agreement at any time. You may close your account via account settings. We may suspend or terminate your access immediately for breach of these Terms. On termination, your licence ceases and we may delete account data per our Privacy Policy. Clauses 7, 10, 11, 12, and 14 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of the Republic of Ireland. The parties submit to the exclusive jurisdiction of the Irish courts for disputes arising under or in connection with these Terms. Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr. We will always attempt informal resolution first — contact legal@aireachly.com.

15. Severability and Waiver

If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.

16. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented at purchase, constitute the entire agreement between the parties relating to the Services and supersede all prior agreements or representations.

17. Amendments

We may amend these Terms at any time. Material changes will be communicated via the platform or email with reasonable notice. Continued use after the effective date constitutes acceptance of the revised Terms.
